When is a Building Permit Required?

State and local laws vary, but permits are always required for new constructions, and, in general, for interior or exterior remodelling of existing buildings, or changes of use.
What constitutes ‘remodelling’ varies between jurisdictions, and even, effectively, within jurisdictions when local zoning regulations are taken into account. Cosmetic changes to a property are just as likely to required appropriate permitting as structural adaptations. Changes in signage, for example, is a common reason for retail businesses making permit applications.
Aside from new builds, construction projects that might require permitting include (but are not limited to):
• Build-outs and interior remodelling of retail premises
• Major repairs or alterations to a structure, or major cosmetic changes such as new signage or radically different exterior decoration
• Full or partial demolition of an existing building, for the purposes of clearance or adaptation.
• Utility installation or adaptations. Although building permits are not often needed for simple maintenance of utility supplies – such as rewiring or pipe maintenance – they are commonly required for major projects, and, in particular, plumbing projects that might affect local the integrity or pressure of the local water supply.
• Change of use or occupancy. Checking local regulations and getting the right permit for change of use is particularly vital with respect to zoning. What seems like a simple change of use – say, a private home into a medical or veterinary surgery – might be affected by zoning regulations governing traffic flow, parking and commercial usage of property within a predominantly residential area.
