Federal Involvement in the Building Permit Granting Process

Once your building project exceeds a certain size then it’s possible that at least some of the permit application process will be governed by Federal regulations. In many cases states are mandated to supervise and manage permits that require Federal checks and permissions, but this is not always the case.
There are a number of situations in which Federal agencies may become involved in a permit application process, and for which some level of Federal oversight is mandatory:
• If the project involves the clearance or disturbance of more than five acres of vegetation, the terms of the National Pollution Discharge Elimination System (NPDES) may come into effect.
• Construction along rivers or in wetlands – which are the engineering responsibility of the US Army Corps of Engineers – may need to satisfy a range of conditions governing environmental protection and drainage.
• Storm drainage issues are covered by the Federal Clean Water Act
• The Americans with Disabilities Act covers disabled access in areas open to the public. ADA and FCWA are usually monitored by local authorities, but Federal Government may become involved in the oversight of large or otherwise complex cases.
Federal regulations have the benefit of at least being universal, rather than varying between States and jurisdictions.
